BVA–GET ‘EM WHILE THEY’RE HOT- NEW DECISIONS FOR FALL 2012


Here’s the latest release of new HCV decisions for Fall 2012. They are dated from April forward. vA only releases the first 400 of each batch whereas before you could research each and every one of them. Now why is that?

    I feel for those who did not live up to the military code of being a monk while in service. It would be interesting indeed to see a case come along where the individual had none of the associated risk factors currently used to deny claims. No tatoos, no shared razors, no type of drug use and no indulging in high risk sexual situations. The only common denominator would be the air gun injections. It would be interesting for the VA to try and wiggle on this scenario. The only saving grace in my particular case was that as a medic we were constantly exposed to needle sticks. I am non specific as to causation but I am sure where I picked this up and it was not needle sticks. I received air gun injections in 74 and the first sign that something was amiss was in 76. First episode showed elevated liver symptoms, multiple sick call visits with “flu like symptoms and weight loss. In 76 they could not identify it as hep-c and obviously there was no treatment. The VA is in such a hurry to deny air gun causation that they are deny healthcare for thousands to save money and prevent the inevitable stampede which is surely coming.
