2013 BVA DECISIONS ARE OUT


Like the post says, it’s springtime and that’s about how long it takes to start getting these 2013 hepatitis decisions airborne. Last year was an anomaly. It took until August or so to get the site operational. Must have been early Sequestration or a VBMS computer crash.

    I briefly went through the first dozen and one statemen which has a common sign in most of them kept popping up. This is “the appellent never received medication, sought treatment for or was diagnosed with HCV while in service”. This is very distressful if you have the facts, and have had them for years, that there was no difinitive test for HCV so how were you be diagnosed much less treated for an unknown disease. Makes me crazy (slighly above mad as hell) to think of the Vets being denied due process for those who are supposed to be there for us.

    It’s is heart breaking to see so many claims denied because they are not prepared and presented correctly.

    Quick keyword search in the 2013 decisions just now with the term “DBQ” shows 45 hits. Depending on the condition and/or judge, they are accepted as adequate or are rejected. If I have time, it would be interesting to see what the trends are.
