BVA– JETGUN WIN WITH NO NEXUS


This one is clean as a whistle. The Veterans Law Judge threw out the biased VA examiner’s  tripe about how it was due to a life of drug abuse after service as being “picky”. This one defies logic. I’ve never seen anything like it. All I can surmise is the guy was related by birth or marriage to the Judge. Either that or a large sum of money traded hands in the parking garage under 810 Vermin Ave. NW.  Come on. The guy was pro se and didn’t even have a VSO to screw it up. No nexus, no nothing. Any other ideas?

    May be too early to tell, but do I smell a presumptive on the way? Tthe CDC came out with a recommendation that boomers be tested, yet they gave no reasons as to why or how they could have been infected so long ago. How did a million boomers then go undetected for so very long? What happened to the millions of Vets with HCV that VA reported to Congress about in 1999? How many claims in the backlog are service connection for Hepatitis C? How many of the 250,000 claim appeals are related to Hepatitis C? Who will get the liver transplants? How many liver transplants are needed? All of these questions the vA is paid to answer but can’t or won’t!

  3. I would humbly dissent from the majority opinion that Veterans can not get Service connection absent a nexus. There is a notable exception which does not require a nexus: Continuity
    While the single judge case below is non precedential, it does explain it well and, cites precedential cases.

    Here again an act of God cut through years of vA bullshit. This RO is bad news since it screwed me back in 2001 for HCV. I did have a vso who did not object to an altered nexus that was used to deny my SC. My fight is righteous and eventually I should prevail. Yet when I read this decision it make me smile in a sick sort of way. Justice is not a constant. Some of us have to fight for everything and endure to tell the tale. Los Angleles RO is a cluster**ck and everybody knows it. Is there such a thing as a honest judge in the vA? Hope I meet him before the coroner….
