vA–ARE THEY RUNNING OUT OF CLAIMS TO ADJUDICATE?


Bob the Leagle Beagle (and member Emeritus) sends us this interesting tidbit with the rejoinder

Because we(vA raters) have lots of time on our hands and are all caught up with our work.

The meat of the email is thus. A fellow who has not filed anything is now being pestered by the vA who will attempt to increase his rating to TDIU sometime in the not too distant future (2015?)

Now here is a new trick.

I’m sure most of you have heard something about the VA might be going to reopen and review our Unemployability claims.

Well here it is.  Got this letter the other day.  I have not filed a new claim.

I called the number below and they gave me the time that they would call me back for a conference call.

next day the call right on scedule, they said that my name was drawn for the review of Unemployability.

I told him that my award said no further reviews,   answer: we are reviewing Unemployability claims.

I ask him about the new claim I was supposed to have filed.

He said again my name was drawn.  Would say nothing about the new claim that I did not file.  Bullshxt  Bullshxt!   WHATS NEXT??????

 

LETTER:

We have received your application for benefits. It is our sincere desire to decide your case promptly. However, as we have a great number of claims, action on yours may be delayed. We are now in the process of deciding whether additional evidence or information is needed.

 If we need anything else from you, we will contact you, so there is no need to contact us in the meantime. If you do write us, be sure to show YOUR file number and full name, or have it at hand if you call.

Editor’s note:

I have one thing to add. Has anyone from the vA gone outside their RO and tried Dial-a-Prayer recently? You’ll be lucky if you only get gray hair waiting for a live operator. I’ve heard cases of extreme tinnitus ensuing from listening to the music while waiting for several days. Another disease on the rise in homes only equipt with the old-fashioned land line is Anorexia. This ensues when you are forced to wait and fear missing the operator. If the cord is not long enough to reach the refrigerator, starvation can occur. Depends® undergarments are a must before dialing.  I strongly suggest starting on Monday Morning early to avoid a long weekend wait. Cel phones with a battery from hell are the preferred alternative. If you call frequently, be sure to put in a claim for SMC-S housebound as well. That’s where you probably will be spending all your time when calling them.

    ooohhh! That looks like it could be the work of a Fiduciary Activity “special agent” doing a “field Investigation”. That appears to be a “Special Agent” jacking up a veteran to try and take their TDIU away from them. If a special agent finds that the Vet is in any way being uncooperative, they can rip away their TDIU. Statute does not define what “uncooperative” actually is. This appears to be an attempt to get an uncooperative response from a Vet! Some of that tyranny and oppression that we went off to defend against, is being wrought upon us! THIS SUCKS SWAMP WATER!

    If said claim is not reviewable then get the attorney on it. If you have not filed a new claim doesn’t it stand to reason that this is simple harrassment at the least. I guess I would again divert for further investigation by the attorney. Just my take on it.

    This has been in the works for a few years according to a very vA experienced retired employee that we know. It was first brought about from the OIG inspections, but there have been certain elected members that sit on the starboard side of the aisle that demand vA revisit IU claims. Some of the starboard representatives are convinced us Veterans are just scammers, and thats why IU claims have been granted two fold in the last 7 years.
    Senator Tenny Runner Brigade, as well as the Senator from the Hula-Hoop and grass skirt state have been fighting this tooth and nail.
    Not being political here, and just the messenger providing info gleaned from said recently retired person.
