Class Action: Against the VA


Hmmmm…I wonder if shredded evidence amounts to “denial of due process”.

This Vet has launched a class action suit, and we are apparently asked to join him.

I would be very interested in Vets comments on this!

    Hello Gary, My name is Quancidine Hinson-Gribble and I am very happy that I joined your lawsuit when I did. The VA has destroyed, redacted, sanitized, forged signatures and “PAID OUT” both of my claims to somebody other than myself. Now the VA does not have any of the documents that I mailed them “USPS Priority Mail, with “Signature Confirmation”. Their best answer to that was, the person who signed for both of my packages at the BVA in Washington, DC does not work for the VA? So, what is that telling us? It is telling us that the U.S. Department of Veterans Affairs is running a CLANDESTINE CRIMINAL ORGANIZATION who are getting PAID not to give us our money. I THANK GOD, that I have all of my documentation and that I am ready for our court date. The WHOLE WORLD needs to know about all of the “FRAUD” and “THEFT” that is going on at the U.S. Department of Veterans Affairs. The WHOLE WORLD needs to know that these people don’t give a damn about our VETERANS, their SURVIVING SPOUSES and their FAMILY MEMBERS. These bastards are going to pay dearly for what they have done to us!!! #canyouhearmenow #QuancidineForPresident, Quancidine Hinson-Gribble, Surviving Spouse of Robert Gribble who passed on November 18, 2011.

    My husband has a claim for PTSD in with the VA for 13 years… I am sickened that they ask you to serve, but don’t compensate. We are filling out the paperwork NOW to join your suit.

    Hello Gary I was searching on Google and found you my father passed in 2011 he had gotten Hep C from air gun injections in Vietnam the hep C caused Cirrhosis of the liver my father never drank a day in his life. He passed from something he did not cause it was caused from the US government and now he is gone and they will of course not take the blame I am not sure how this helps but I would do whatever I can to help your cause.

    Gary, I do believe in your efforts to reward yourself and several hundreds of thousands of Vietnam Vets who served honorably and now are being denied again and again, just as my husband who is a retired MSGT, US Air Force and his now terminally ill and in hospice here in our home. I am his caregiver 24/7 and I don’t receive any compensation for it. He too, served in the capacity of “Secrecy” with classified/secret missions with the Air Force as so many before and after him did. When he retired in 1979, the VA granted him 10% disability for hypertension. Today, with several additional illnesses that the VA considers presumptive due to herbicide exposure, he is still at 10%. I notice they have moved his file from Oakland HDQTRS to Muskogee, Oklahoma VA. What is the deal? I was at the Oakland DAV in June and noticed several cubicles were empty of people and supplies. Are they going to put that office and the Oakland VA HDQTRS out of business. If so, its a good thing, We have been dealing with them since 2007 and they have denied my husband 3 times since 2007. How do we join you in your class action suit as we would love to do so. I see so many vets out here in Sacramento asking for just a little bit of food or they want to work for food. So Sad and I say to you “Keep up Your Good Work Faithful Servant and May God Bles You abundantly for your gallantry. Thanking you so very much.

    Yes I sent my 2 notarized copies to Gary Kendall in Boise IA a few days ago. I don’t think the shredding got here to CA but the truth will eventually come out. I did ask around some of the vso’s at my VAMC. No one knows of this action. Even if the suit wins the lawyers get all the money anyway. Should we give a shit? No sleep lost here….

    Now that’s interesting………….

      Hi: I am Gary Kendall. Are all you questioners nuts?

      Joining this action costs you nothing but some time and postage! You can not be legally retaliated against for joining us! IF you are retaliated against and you document it and file complaint about it (I will guide you) you will get MORE money for the unlawful retaliation!

      What do you care if some attorney comes on board and gets some of an award or settlement, you can’t get ANY of that named class money any other way but joining with us!
      So you will have lost NOTHING and gained whatever money does come your way!

      You will have added your name to history for standing against an errant government and VA to correct things for all Veterans present and future!

      As a Veteran, you will have served your nation – in honor – once again!
      As a civilian, you will have served with the same honor as the Veterans!
      As a Christian, you will have enforced the Word of God that a workman is worth his wages and that a contract must be honored!
      As human beings, you will have stood together to enforce international Human Rights!

      For nothing more than the cost of some printing, a signature, and some postage!

      When have you ever been offered a chance to change history and take a stand for so much good – for less than a dollar!

        Thank you for your service. Are we nuts? I think not!! I think we have been screwed over and over again by the vA, attorneys, VSO’s, Ro’s, and our elected officials. I am speaking for myself here. My screwing began in 2001 when I filed for HCV service connection. I had a corrupt rubber stamp vso called the Ca dept of veteran Affairs. They ignored a “altered nexus C&P exam results” and I was denied illegally. Between then and now I have fighting a corrupt vA system of denials and delays that only favors the govt. The govt has added insult to my injuries. Am I still nuts? Not… BUT I am very sick today as my disease progresses. What have I done to my govt to deserve this treatment? I earned an honorable discharge. I did my tours and obeyed my orders. Yet I am treated like a bastard son who is trying to get something he didn’t earn. I agree the shredding incident is an abonination to all veterans. A shredded document didn’t deny my claims for HCV or alter my evidence. A shredded document did not cause my cancer or turn me into a prescription drug addict. Your action has merit sir. However TO CALL US NUTS IS FIGHTING WORDS! Maybe we need to exchange our shoes and see who walks taller. Change history? Only God can do that. I hope this action prevails in my lifetime. Yet I know a win in court will not give back what the vA has done to me. There are many here that bode worse than me. I hope you can get some heavy guns to back you up as the lawsuit progresses. I paid my dues and have no more to give. WE ARE NOT NUTS!!!!!!!

          It appears that my response to people in several groups – not just here – got posted as a reply directly to you in this group! It was meant as a general post to those who are questioning whether or not I am “scamming” Veterans in some unspecified way!

          I will accept responsibility for the mispost as a direct reply to you when it was not intended that way. I am tired, I am older, and even though I have been using the internet for years, I do not understand how everything on the internet works.

          I have yet to figure out the difference between posting to this site and posting in response to a specific reply! I hope that this post does appear in direct reply to yours, Robert.

          That “Are you nuts?” post was not meant as a reply to you, Robert, it was meant as a mass post to many sites in response to “negative nellies” who were trying to state that somehow I am scamming people out of their money.

          THAT angered me greatly, not once anywhere by any means have I asked for anyone to send money or property to me to assist in this action, none is needed, and I will not rip off those Veterans and families who have been so terribly disenfranchised by an rogue VA!

          It is absolutely true, and documented, that the VA has tried to kill me several times – my statements to that effect are not to “measure shoes” but to let all understand that my heart and soul are with the veterans and their families for very good reason – I have also been treated badly by the VA!

          I am one of the Veterans, I take my oath of service seriously, and I am still willing to lay my life on the line for the benefit of my nation, my fellow citizens, and my brother and sister Veterans! I am doing that right now. I ask no-one else to lay their life on the line with me, it only takes the one to do this, with all others listing as plaintiffs in the action!

          I am trying the best I can to let everyone interested know what kind of person I am, I owe them that for their willingness to side with me as plaintiffs in this action. Believe me, I would rather be anonymous and go fishing! But, I am called to do this – fishing will come later.

          I’m not trying to “measure shoes” with anybody, Robert, I am trying to make sure that everyone interested has a clear opportunity to learn about the class action, to read the complaints, and to join us if they wish – in the absence of as much negativity thrown at us as I can shield against!

          It is TOTALLY unfair for negative persons to be throwing about unfounded statements of “scam” or “ripoff” where none exists and no way exists for that to be done! The court will prohibit all opportunity for that to happen!

          I have not asked for any greater redress for myself or others than is asked for ALL plaintiffs, the proof is in the officially filed written Complaint section on Prayer for Relief!

          I stand with as much honor and stamina as remains in my soul against the VA violations of law and contract, and I only ask that those Veterans and family members who wish to make a stand with me do so with the investment of their Joinder Notices and postage! That is all I ask.

          If you wish to change your mind and have your Joinder Notices back, I will return them to you as soon as I receive them and your request.

          Each individual’s status in this action will always remain their free will choice, not one person is forced or trapped to do anything here they do not wish to do – everyone is a volunteer.

          Each is asked to read the Complaint – and provided means of access – so they know exactly what they are joining.

          Each individual has been offered multiple avenues by which to ask questions and get answers to the best of our ability.

    Hi:

    I am Gary Kendall, the author of the Veterans Civil Rights class action mentioned in the original post. I am neither a lawyer or a doctor, I am a disabled Veteran of honorable USAF service during Vietnam, and a Veterans’ and citizens’ rights activist and advocate.

    Though the action is filed asking for monetary damages to the Veterans and their immediate family members, that is not the purpose of the action.

    The purpose is to make notice to Congress that continuing failure to bring VA to task and correct its rampant, rogue, violations of law will continue to cost the USA millions if not billions in renewed, repetitive litigation actions – TO FORCE Congress to correct and rebuild VA, and to install effective, authoritative and powerful oversight to keep VA in line through the future.

    This IS NOT for the money… THIS IS FOR the proper VA provision of the property rights of Veterans and their families to VA medical care and benefits under the established contract for the Veterans’ active duty service during peace or war!

    Regarding attorney’s fees: at present we have no attorney, I wrote and filed this action myself after twelve years of study and self-written actions before the courts.

    I lost some and I won some – nobody is perfect! What i did consistently is LEARN about the law and how the courts operate – both legal and illegal operation of the courts.

    Now, in this action, we Veterans play “their” game back against them, using their own rules!

    All Veterans, present and future, need your voice added to this action to make the issues heard LOUDLY in DC! Very directly, folks, this is an action full of the honor of individual Veterans and family members who have had enough of the VA violations of law and rights!

    In this case, people, if you are not part of this solution, you really are part of the problem – the apathy and silence that has allowed the VA to degrade into a hostile and abusive government agency. Please add your voice to ours and help us begin the necessary improvements to VA!

    When this action is certified by the court and moves forward, the court is mandated to assign class counsel (one or more attorneys), however, because they did not research or write the action they are not entitled to the huger percentages of the award or settlement that usually attends attorney representation! They will be severely limited in what they can take as compensation.

    Also, those who have spoken to that “problem” have failed to consider that when we win this action, the respondents have to pay the legal fess and costs for us, not ourselves! The amount our attorneys want in compensation will be ADDED to the final award or settlement, not taken away from it!

Judging by what the en banc court at the 9th Fed Circus just did to Vets down in SF, I’m not sure how this will fare. Hopefully it will raise a ruckus and make America sit up and take notice.
