   You ignore one consideration. Virtually everyone seated at the the 9th Circus is 10 miles left of neutral. That’s why we call it the Left Coast. I expect it to be 10-3 in favor of our team with some harsh repair orders. Remember forced busing (and integration)by the 5th Fed. Cir. in 1967?

     Actually the fact that most of the Judges on the 9th are liberal was a big part of my comment. Liberals tend not to like war Veterans. Shinseki was appointed by Obama so I don’t expect them to eat their own young. But I certainly hope you are right….we Vets need a break and really soon.

   Be interesting to see what the 9th CCA will do. This issue gets right to the heart of the purpose of the VA. Which I’m sorry to say has been lost in my opinion. I am one of the vets who isn’t getting proper medical care. I am also a disabled veteran that was discriminated against by losing my Government Service Appointment when I had 5 years left to retire with some sort of pension. It used to be called oppression at the hands of Government which is why we donned a uniform and went overseas to a foreign land to fight against! Now our own Government is treating us Veterans like used up toothpaste tubes!

   I expect this CCA to come out with some mediocre decision because of the election year. That or delay it until after the election. After all, federal judges are appointed by the president, even though it is a life term. I only voted once, let it be an “enbanc” poll….
