Shoot. Did I get enough ‘m’s in there? Gotta go listen to the song again to check. In this day and age, you have to put your foot down when the poop hits the rotary oscillator. This, I did. Yesssss. As for whether  Veterans Law Judge Lauren Cryan actually agreed to it, I could care less. She made her position blatantly clear from the outset of the hearing to the bitter end- actually even before I was sworn in. The short pre-hearing colloquy was actually more contentious than the hearing itself. That’s when I knew this was going to be an exercise in futility. Too bad we don’t get to pick our own judges but then you don’t always get a lime wedge with your Corona or a lucky extra bounce on your grenade.

 

I’ve been really busy and neglected to check my own c-file in VBMS. I’d wondered why I hadn’t heard one way or another as to whether they were going to give her the boot or not. And lo and behold, the USPS good tidings actually got here before I deigned to check VBMS. Shut the front door.

Anyway, not much to report here. Attached is the redact of my hearing transcript, my feelings on the subject in my Motion and the Dep. Chairman’s kindly reply. It’s a valuable tool in those rare circumstances when you find yourself in a Pickle.

File this one under “Watch that the door don’t bump your  ass on the way out”.  One thing I always say to VA’s litigators before we strap on our armor is that this isn’t about you and me. It’s about the Veteran. Remember him? The guy who has borne the battle?  It just so happened this happened to me and not one of my clients. I’d like to think I saved VA a lot of face by not putting it on Channel 7 at 6 PM. And that’s all I have to say about that.

    I thought Judges insist on seeing evidence, and this one pretended to be so keen on the medical facts. And are supposed to rule based by the exact words of case law.
    Riveting.
    There is also an interesting female-knowledge basis for some of the J’s questions about weights, measures, how spaces and things are put together. I could relate to her questions. Why?
    In general, most women don’t build big things, lift heavy things, design skyscrapers, or build sheds, insert windows, HVAC and so forth. J repeatedly showed how she didn’t have experience with engineering tasks males learn about and normally perform. (There are not many women in construction trades even now.)
    So her questions about the problems regarding the smaller greenhouse square footage as not meeting needs, are normal. She simply didn’t know the practical answers and fell back upon her feelings or sense of ethical fairness–suspected greediness, give the grants to others; she had trouble concentrating on how things fit together & reason.
    No matter how intelligent and talented,
    females’ education has been narrowly focused on domestic work and talking. They were barred from advanced medical training, universities, voting, etc. until the industrial age changed things. With urbanization, females had to learn how the “outside” world functioned. Some prepper ladies are getting a handle on these practicalities by doing hard stuff by themselves. For others, nurturing children and others, having good social skills, and enjoying modern conveniences, is the logical, less stressful choice.

    Another shining example of knowing the law and history and how it ties together. The judge took the defensive posture and was arguing about your right to disability and did a poor job of justifying her many conversational directions concerning your right to a larger greenhouse that was already granted to you. Holy cow, this hearing had as much or more verbiage etc than a supreme. Court case?? Unbelievable! When you get the larger greenhouse I want an order of green tomatoes 😂 then I can make some green eggs and ham Sam … nice job! This appears to have been right before my appeal in San Diego ? Your the man,!! C
